Agreement to Terms

By accessing or using Caloa AI ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Description of Service

Caloa AI is a mobile application that provides AI-powered calorie and nutrition tracking through voice, photo, barcode, and text input. The App also provides personalized nutrition plans, meal recommendations, weekly insights, and AI coaching.

Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, please do not use this App.

Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

Health Disclaimer

Caloa AI is not a substitute for professional medical advice, diagnosis, or treatment.

• Nutrition estimates are approximations and may not be 100% accurate
• Always consult a healthcare provider before making significant dietary changes
• Do not rely solely on the App for managing health conditions
• If you have eating disorders or medical conditions affecting diet, consult a professional
• AI-generated content should not be used to diagnose, treat, cure, or prevent any disease

Subscriptions and Payments

Free Trial: All plans include a 7-day free trial to try all features.

Subscription: After the trial period, a paid subscription is required. Subscriptions are billed through the App Store or Google Play Store. You agree to their payment terms.

Cancellation: You may cancel your subscription at any time through your device's app store settings. Access continues until the end of the billing period.

Refunds: Refund requests are handled by Apple or Google per their policies.

Freemium Service and Advertisements

Caloa AI offers a free tier supported by advertisements. By using the free tier, you agree to the following:

Advertising

• Free users will see banner ads displayed during app usage
• Interstitial ads may be displayed between certain actions
• Rewarded video ads are available to earn temporary ad-free periods and bonus AI requests
• Ad frequency and placement may be adjusted at our discretion

Rewarded Ads

You may choose to watch rewarded video ads in exchange for:

• Temporary ad-free periods (duration displayed before watching)
• Bonus AI requests beyond your hourly limit

Rewards are verified using server-side verification. Attempts to fraudulently claim rewards may result in account suspension.

Premium Subscription Benefits

Premium (Pro) subscribers enjoy an ad-free experience with higher AI request limits, depending on their subscription plan.

Usage Limits and Fair Use

To ensure fair access for all users and maintain service quality, Caloa AI implements usage limits:

AI Request Limits

• Free Tier: Limited AI requests per hour (current limits displayed in-app)
• Premium Tier: Higher AI requests based on subscription level
• AI Live Sessions: Limited sessions and duration per day for free users

Bonus Requests

Free users may earn bonus requests by watching rewarded ads. Bonus requests do not carry over between billing periods.

Rate Limiting

If you exceed your usage limits, you will be temporarily unable to make AI requests until your quota resets or you upgrade your plan. We reserve the right to modify usage limits with reasonable notice.

User Content

You retain ownership of content you submit (photos, meal logs, voice recordings, etc.). By submitting content, you grant us a license to process, analyze, and store it for the purpose of providing the service.

Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the App
• Reverse engineer or decompile the App
• Use the App to collect data about other users without consent
• Upload malicious content or code
• Share your account with others
• Provide false or misleading information

Account Suspension and Termination

We reserve the right to suspend or terminate your account, without prior notice, for any of the following reasons:

• Violation of these Terms of Service
• Abuse of the AI request system (e.g., automated requests, excessive usage intended to overload systems)
• Fraudulent ad interactions (e.g., clicking ads repeatedly, using bots, falsely claiming rewards)
• Circumventing usage limits or rate limiting
• Creating multiple accounts to abuse free tier benefits
• Any illegal activity or activity that harms other users
• Attempting to reverse engineer or hack the App
• Providing false information during account creation

Upon suspension, you will lose access to the App and all associated data. We may, at our discretion, provide a warning before suspension for minor violations. Suspended users may appeal by contacting contact@caloa.ai.

Intellectual Property

The App, including its content, features, and functionality, is owned by Caloa AI and FAMO Connect LLC, and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

Indemnification

You agree to indemnify and hold harmless Caloa AI, FAMO Connect LLC, and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Any content you submit through the Service

Limitation of Liability

To the maximum extent permitted by law, Caloa AI and FAMO Connect LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App, including but not limited to:

• Any health issues arising from following AI-generated recommendations
• Inaccuracies in nutritional estimates or meal analysis
• Loss of data or service interruptions
• Any decisions made based on information provided by the App

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or completely accurate. We make no warranties regarding the accuracy of AI-generated content.

Termination

We may terminate or suspend your account at any time for violation of these terms. You may delete your account at any time through the App settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in Fulton County, Georgia.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify you of significant changes through the App or by email.
